FORM, TYPE, AND METHOD OF THE ISSUE OF DOCUMENT ON FISH QUARANTINE ACTION

Considering:
- a. that in order to implement Article 51 paragraph (5) Government Regulation number 51 of 2002 concerning Fish Quarantine, it is necessary to lay down a provision on form, type, and method of the issue of the document on fish quarantine action;
- b. therefore, it is necessary to lay down provision on Decree of Minister;
Referring to:

HAS DECIDED :
To Stipulate :
REGULATION OF MINISTER OF MARINE AFFAIRS AND FISHERIES CONCERNING FORM TYPE, AND METHOD OF THE ISSUE OF DOCUMENT ON FISH QUARANTINE ACTION
Article 1
As used in this regulation :
- 1. Main document is a document in which the management is handled by the institution of fish quarantine in the level of Centre; explains that carrier media mentioned in it is free from quarantine pests and diseases of fish and/or required pests and diseases of fish; and becomes administrative requirement of moved carrier media.
- 2. Supporting document is a compulsory document in which the management is conducted by the institution of technical implementation of fish quarantine, explains that carrier media mentioned in it is shall be subjected to one of quarantine actions.
- 3. Health Certificate for Fish and Fish Product is an official document signed by fish quarantine officer, state that carrier media mentioned in it is free from quarantine pests and diseases of fish and/or required pests and diseases of fish.
- 4. Letter of Domestic Fish Health, additionally mentioned as Latter of Domestic Fish Health is an official document signed by fish quarantine officer for the movement of carrier media from one Area to another within the territory of Republic of Indonesia, states that the carrier media mentioned in it is free from quarantine pests and diseases of fish and/or required pests and diseases of fish.
- 5. Release Certificate of fish quarantine is an official document signed by fish quarantine officer, states that the carrier media mentioned in it is free from quarantine pests and diseases of fish and/or required pests and diseases of fish, so that it can be imported to the territory of the Republic of Indonesia or moved to one Area in the territory of the Republic of Indonesia.
- 6. Letter of Temporary detention is an official document signed by fish quarantine officer, states that the carrier media is detained in the entry/exit place because the quarantine document and/or other requirement or required additional obligation is not complete or unarranged, or its ownership remains unknown.
- 7. Letter of Refusal is a document sign by fish quarantine officer in the place of entry/exit, state that the entry/exit of fish quarantine is refuse, because the carrier media is not free, cannot free from quarantine pests and diseases of fish, or does not fulfill other requirement.
- 8. Recommendation Letter of Fish Quarantine Installation Entry is an official document signed by fish quarantine officer, states that the carrier media imported to the territory of the Republic of Indonesia or moved from one area to another within the territory of the Republic of Indonesia, or will be exported from the territory of the Republic of Indonesia, that is subjected to quarantine action, is instructed to enter fish quarantine installation for quarantine action.
- 9. Minutes of Destruction is a minutes made and signed by fish quarantine officer and the owner or the representative in place of entry, state that destruction has been conducted to imported carrier media, either because it is not free or cannot be free from quarantine pests and diseases of fish or because it does not fulfilled the quarantine requirement and other requirement.
- 10. Recommendation Letter of Fish/Fisheries Product Movement is an official document signed by fish quarantine officer in place of exit, states that the carrier media can be exported from the Republic of Indonesia or moved to other area within the territory of the Republic of Indonesia because it is not included as a type of forbidden, controlled/restricted fish/ fisheries product.
- 11. Inspection is an action to notice the completion and prerequisite document as well as to detect quarantine pests and diseases of fish and/or pests and diseases of fish.
- 12. Owner of carrier media is a person or legal body that owns the carrier media and/or responsible on the entry, exit or transit of carrier media.
- 13. Other requirement is provision outside fish quarantine provision that should be fulfilled by the owner of carrier media which is going to be conveyed; its authority is handed over to fish quarantine officer.
Article 2
(1) Document of quarantine action consists of main document and supporting document.
(2) Main document as mentioned in paragraph (1) consist of :
- a. Health Certificate for Fish and Fish Product;
- b. Health Certificate for Domestic Fish;
- c. Release Certificate of Fish Quarantine.
(3) Supporting Document as mentioned in paragraph (1) consists of :
- a. Letter of Temporary Detention;
- b. Letter of Refusal;
- c. Recommendation Letter of Fish Quarantine Installation Entry;
- d. Minutes of Destruction;
- e. Recommendation Letter of Fish/Fisheries Product Movement.
(4) The form of quarantine action document implied in paragraph (1) is as mentioned in Appendix of this Regulation.
Article 3
(1) Health Certificate for Fish and Fish Products as implied in Article 2 paragraph (2) alphabet a is issued if quarantine action is performed to carrier media which will be exported from the territory of the Republic of Indonesia and that it has fulfilled the prerequisite inquired by country of the destination.
(2) Health Certificate for Domestic Fish as implied in Article 2 paragraph (2) alphabet b is issued if quarantine action is performed to carrier media that will be moved from one area to another within the territory of the Republic of Indonesia and testifies that it is free from quarantine pests and diseases of fish.
(3) Health Certificate for Fish and Fish Products as implied in paragraph (1) and Health Certificate for Domestic Fish as mentioned in paragraph (2) are issued in designated places of exit.
(4) Health Certificate for Fish and Fish Products and/or Health Certificate for Domestic Fish as implied in paragraph (1) and paragraph (2) are only for 1 (one) time exit/shipping of carrier media, and should be utilized as a part of exit/shipping of carrier media not more (three) days after issued.
Article 4
(1) Released Certificate of Fish Quarantine as implied in Article 2 paragraph (2) alphabet c is issued if carrier media introduced has been attached with Health Certificated for fish and/or Fisheries Product from the country or area of origin and testified as free from quarantine pests and diseases of fish.
(2) Release Certificate of Fish Quarantine as implied in paragraph (1) is issued in designated places of entry.
(3) The issue of Released Certificate of Fish Quarantine as implied in paragraph (1) is only for 1 (one) time for carrier media entry.
Article 5
Letter of Temporary Detention as implied in Article 2 paragraph (3) alphabet a is issued if, in fact, the entry/exit of carrier media is not attached with Health Certificate from/to the country of area of origin/destination and/or other requirements or required additional obligation or unarranged or its owner remains unknown, after requirements and validity of the document is inspected.
Article 6
Letter of Refusal as implied in Article 2 paragraph (3) alphabet b issued if :
- a. In 3 (three) days after detention, the owner cannot complete Health Certificate or the carrier media is not free from quarantine pests and diseases of fish;
- b. The owner cannot complete other prerequisite or additional obligation inquired in accordance with existing provision.
Article 7
Recommendation letter of fish quarantine installation Entry as implied in Article 2 paragraph (3) alphabet c is issued if carrier media imported to the territory of the Republic of Indonesia or moved from one area to another within the territory of the Republic of Indonesia, or will be exported from the territory of the Republic of Indonesia, is instructed to enter fish quarantine installation for fish quarantine action.
Article 8
Minutes of Destruction as implied in Article 2 paragraph (3) alphabet d is issued if carrier media is destroyed.
Article 9
(1) Recommendation Letter of Fish/Fisheries Product Movement as implied in Article 2 paragraph (3) alphabet e is issued if carrier media inspected is not include as type of forbidden or controlled/restricted fish/Fisheries Product.
(2) Recommendation Letter of Fish/Fisheries Product Movement as implied in Article (1) is issued in designated places of exit and only for 1 (one) time of carrier media exit/shipping.
Article 10
Quarantine officer in designated places of entry or exit for carrier media issue document of quarantine action as implied in Article 2 paragraph (2) after the owner pays the charge of quarantine service in accordance with the existing provision.
Article 11
(1) Document of quarantine action issued by quarantine officer as implied in Article 2 paragraph (2) and paragraph (3) alphabet d and e is handed to the expecting owner or the institution not more than 1 (one) day after quarantine action after quarantine action either entire or partial.
(2) Document of quarantine action issued by quarantine officer as implied in Article 2 paragraph (3) clause a, b, c is handed to the expecting owner or institution before quarantine action either entirely or partially.
Article 12
Document of quarantine action issued by quarantine officer as implied in Article 2 paragraph (2) and paragraph (3) can be directly handed by quarantine officer or through electronic facility to other expecting institution.
Article 13
The Regulation shall come into effect on the day of publication.
